The court granted leave for the Securities and Futures Commission to intervene because the Actions concerned matters provided for in the relevant provisions of the SFO, the Commission had an interest by virtue of its functions, it had consulted the Financial Secretary and intervention was in the public interest; there were reasonable grounds to suspect possible market misconduct and a real risk that the defendant would not defend vigorously, thus justifying intervention and a stay to preserve potentially dissipable proceeds.
