The court granted interlocutory injunctions restraining the Bank from disclosing the plaintiffs' Hong Kong account information until trial or further order because the plaintiffs established a serious question to be tried under Hong Kong law, damages would be inadequate given the irreversible nature of disclosure, and on the evidence the Bank was not in real jeopardy of successful contempt sanctions in US courts owing to the availability of foreign compulsion/good faith defenses; accordingly the balance of convenience favoured the plaintiffs.
