On the balance of probabilities there was no agreement to accept short shipment; plaintiffs short‑shipped in excess of normal commercial tolerance (3%); therefore under s32 of the Sale of Goods Ordinance the buyers were entitled to reject and plaintiffs' claim fails; defendants' counterclaim dismissed for lack of evidence.
