Defendants failed to demonstrate with adequate particularity and credible corroboration that a triable issue exists over subsistence and ownership of the copyright works; their account that a third party (Li Fay) created the original design was implausible given documentary development of the plaintiff's designs and absence of independent evidence from Li Fay; accordingly summary judgment was entered for the plaintiff and the 2nd and 3rd defendants are liable for procuring infringement if the 1st defendant is liable.
