Although giving buy or sell orders to an exchange member constitutes "trading in commodity futures contracts," on the magistrate's factual findings Renown's dealings with the five users did not create an agency relationship; Renown traded "otherwise than as agent" in respect of those users and therefore fell within the s.26(4) exemption so that s.26(1) did not require registration and the acquittals were correctly entered.
