Plaintiff failed to discharge the burden of proving the awning was attached to common parts; evidence and judge's findings showed the awning formed part of the shop/demised premises and benefited the tenant (D5), so the maintenance duty lay with the tenant/owners (D5/D1-D4) under s.34H and related principles; accordingly D6 (incorporated owners) was not liable.
