The Court of Appeal dismissed the Secretary for Justice's appeal, holding that the Chief Judge did not err in law or in the exercise of his discretion in admitting Mr Owen ad hoc; the judge properly balanced competing public interest factors (novelty, unusual difficulty/complexity, public importance, likelihood of appellate issues and public perception), and overseas counsel’s assistance and comparative jurisprudence could be of significant value in this NSL and sedition context.
