The application for leave to apply for judicial review was dismissed because the impugned directions (aerial photos and proposed site inspection) were intermediate/procedural, lacked the necessary exceptional utility to justify intervention, the site inspection direction was not extant (rescinded/moot) and the BAT's powers under sections 49, 50 and 53 permit reception of evidence and inspections for determining appeals including at preliminary hearings; there was no reasonably arguable case of illegality, bias or constitutional incompatibility.
