The summons was dismissed because the applications were procedurally defective and without merit: the plaintiffs had not shown proper service or statutory authority to use Form 10, had no evidential basis to compel a non‑party affidavit, the duty to provide defendant addresses rested with the plaintiffs, and the court must protect non‑parties from abusive service; accordingly the hearing was vacated and proceedings adjourned sine die with liberty to restore after proper service and a restraining order was issued against serving the non‑party without court approval.
