The Court allowed the appeal in part: having regard to the amount obtained (HK$16,684), the duration and manner of the fraud, and the guilty plea, the appropriate starting point was 6 months reduced for plea resulting in a sentence of 4 months' imprisonment; the sentence was ordered to run consecutively to the appellant's existing 4-year term. The judge also concluded that section 98 of the Magistrates Ordinance has not been amended to make magistrates' compensation orders enforceable as judgment debts, distinguishing enforcement regimes between magistrates' courts and higher courts.
