The appeal was dismissed because the application to assert that ss.7(2) and 17 of the Limitation Ordinance are inconsistent with the Basic Law and to claim compensation from the private respondents was barred by the principle of finality in litigation: the constitutional point could and should have been taken in the earlier proceedings, and the Court of Final Appeal had already established that the Extension Ordinance did not alter the title or limitation position.
