The court held that the compensation order made under s.73 Criminal Procedure Ordinance directing payment out of the bail money conferred an interest that supersedes the defendant solicitor's equitable assignment; accordingly the Plaintiff is entitled to payment out of the bail money and the defendant's remedy was to challenge the order by judicial review prior to payment.
