On the balance of probabilities the Applicant proved a diminution in open market value attributable to registration of the Order; after critical analysis of comparables the Tribunal adopted a base diminution of -40%, adjusted by +15% for enhancement allowances to reach a final diminution of -25% of the agreed before value, producing an award of $1,338,500.
