The Secretary for Security's 28-day detention under s.32(4)(a) was invalid because at the time it was made there was no s.13E removal order in force; a valid s.32(4)(a) order is a condition precedent to the court's power under s.32(4)(b); therefore the court lacked jurisdiction to grant further detention and the application was refused.
