On proper construction of the Writings as a whole, they constituted a valid testamentary document meeting s 5(2) requirements and the objection provision did not delegate testamentary power to the father or the son but operated (at most) as a condition grafted onto a primary bequest to the Plaintiff; consequently the bequest was valid and the appeal was dismissed.
