The judge found on the balance of probabilities that the letters and answers filed by R2/Ming An objectively influenced R1 to refrain from making admissions and to incur costs; that conduct constituted a special or unusual feature amounting to an affront justifying indemnity costs; accordingly indemnity costs were awarded to R1 for defending the eight ECC claims and for opposing the s 24 indemnity application, with certificate for counsel, and an order nisi that R2 pay R1's costs of the present application on a party-and-party basis if taxed.
