The trial judge erred by disregarding the explanatory content of the appellant's unsworn police statements when those statements had been relied on by the prosecution to prove identity and formed part of the Crown's case; the explanatory material should have been considered and could have raised a reasonable doubt about fault for dangerous driving, and there was insufficient evidence that the appellant knew of or ought to have known about the braking system defect to establish the requisite negligence, therefore convictions were unsafe.
