The court held that, on a true construction of the Labour Tribunal compromise and having balanced the relevant factors, the present malicious prosecution claim was in substance the same grievance already resolved by the Labour Tribunal settlement and pursuing it in the High Court would be an abuse of process; accordingly the Statement of Claim was struck out and the appeal against the Master's decision was allowed.
