The Court held that R v Chow Tin‑wah did not establish a universal six‑year starting point for all forging/uttering cases; in exceptionally large and serious counterfeiting operations a higher starting point is justified. Manufacturing (counterfeiting) and uttering (distribution) are distinct offences permitting consecutive sentences. Applying those principles to the facts, the overall sentence of 13 years was not excessive and the applications for leave to appeal against sentence were refused.
