The Court of Appeal dismissed both appeals: it held Stone J did not misuse his discretion in declining to construe the Determinations at interlocutory stage because material factual issues remained interwoven with legal questions and discovery was incomplete; accordingly it was not appropriate to decide construction under Order 14A; the Judge also properly granted leave to amend since the proposed amendments were arguable; under the Hadmor test no appellate interference was justified.
