The Court of Appeal held that the High Court judge did not misapply his discretion in granting leave to appeal; there was no clear error in his reasoning or consideration of relevant matters and, given the novelty and potential general importance of s2GD, the judge was entitled to permit an appeal. Accordingly the appeal against the judge's grant of leave was dismissed.
