Even assuming for the applicant's benefit that an appeal to the Court of Final Appeal lies and that the statutory provisions raise questions of public importance, the applicant's construction was not sufficiently arguable; accordingly leave to appeal to the Court of Final Appeal is refused.

Section 69(2) is to be given its literal wide meaning: courts have power to limit disqualification to a class or description of vehicle even where a disqualification is mandatory under section 41(2); accordingly the Court remitted the appeal for determination in light of that opinion.

Section 66 must be construed as dealing with assessments subject to valid objection under section 64 and Part 11 matters; the phrase 'any assessment' in s66(1A) only identifies temporal scope and does not broaden the section to cover appeals against assessments to additional tax, so the Board had no power to extend time for such appeals.

A non‑statutory Medical Board's percentage assessment is not binding; for injuries not in the First Schedule the Court must assess the permanent loss of earning capacity under section 9(1)(b) and award compensation proportionate to that loss — on the evidence the applicant's earning capacity was permanently reduced to zero and he was entitled to 100% compensation.
