On the evidence the defendant failed to prove an effective inter vivos gift: the donor did not manifest an unequivocal intention to divest himself of ownership accompanied by sufficient delivery; subsequent conduct by the donor (continued custody, donations in his own name, exhibitions and dealings) was inconsistent with a gift; therefore the Collection remained the property of the deceased and devolved to his estate.
