The court found the reference to a 2014 IRD investigation was background and not sufficiently material to vitiate the ex parte order; the liquidators' reliance on the information was innocent and the injunction would have been appropriate on other evidence of dissipation and a good arguable case; the continuing duty to inform the court exists but did not require immediate recall here; accordingly the injunction was continued until further order and costs were ordered nisi in favour of the plaintiff.
