Although the evidence showed the premises were being used for prostitution at the time of the raid, the Crown failed to prove the necessary element that the premises were 'kept as a vice establishment' (showing a pattern or persistence of use); a single visit without indicia of prolonged use was insufficient, therefore the conviction under s.139 cannot stand.
