The court found the operative sample to be the EPROM/programme that produced one laugh cycle (the checksum-identified programme); SAS supplied ICs conforming to that programme; Gothik wrongfully rejected the pre-production samples and repudiated the contract. Defendant Li nevertheless did not accept repudiation and failed to deliver by the extended dates; he is liable for breach. Accordingly judgment was entered for Gothik for $900,500 and for SAS for $60,329.65; all defendant counterclaims were dismissed.
