The absence of mutuality on the second level (future promises to engage) does not, by itself, negate the existence of a contract of service arising from each specific engagement; mutuality on the first level (work in exchange for remuneration) suffices during periods of actual work, whereas second-level mutuality is only critical when establishing a global/continuing contract for statutory rights under the Employment Ordinance.
