The deceased was the owner-operator of the bulldozer, bore the chance of profit and risk of loss, and exercised possession and control of the machine; on those facts the contract with Express Drilling was a contract for services and not a contract of service, therefore no employer-employee relationship existed with the Respondents and the claim under the Employees' Compensation Ordinance fails.
