The bill of lading's conditions expressly named the defendant as the 'Company' and thus as the contracting party; any alleged secretarial mistake was unilateral within the defendant's organisation and unknown to the plaintiff and therefore did not relieve the defendant of contractual liability; accordingly the defendant was liable as the combined transport operator for the loss and the appeal was allowed with judgment for the plaintiff.
