Applying section 19 purposively, 'contractor responsible' in Regulation 2(2)(a) is not confined to persons performing physical work; it includes persons engaged in carrying out construction by managing, organising, supervising or co-ordinating works and the principal contractor is the head contractor from whom others derive contracts. On the facts the Respondent had the primary contractual responsibility for the site and therefore was the contractor responsible.
