Contractual commission is not to be included in the statutory calculation of holiday pay and annual leave pay under ss.41 and 41C of the Employment Ordinance except possibly where contractual commission accrues and is calculated on a daily basis varying day to day; monthly or otherwise non‑daily commissions (as in this case) are excluded; therefore the Labour Tribunal dismissal is restored and the remitter set aside.
