On the evidence the defendant paid only the immediate purchase costs of HK$28,688.15 (10.68%) while the plaintiff (and his wife, with assistance from their daughter) paid the mortgage instalments, early repayments and ongoing expenses to discharge the mortgage; accordingly the court declares beneficial interests 89.32% to the plaintiff and 10.68% to the defendant and orders corresponding contribution liabilities and costs.
