Advances that were repayable or conditional were not bona fide donations and thus fell within the prohibitions of Cap.288 ss.5 and 8A and were illegal and unrecoverable; HKADPL habitually made loans without a money lender licence so it could not enforce guarantees or recover such loans under the Money Lenders Ordinance; promises to contribute a percentage of honoraria lacked fresh consideration and, where given in exchange for electoral support, were illegal under ss.5(c) and (d) of Cap.288; courts will decline to enforce contracts tainted by illegality even if illegality was not pleaded.
