The trial judge's factual findings that there was no reliable evidence of a strong jet/splash causing extreme fright and that medical evidence did not support that emotional stress caused the stroke were not plainly wrong; there was evidence to the contrary so the statutory presumption in s5(4)(a) did not apply; therefore the stroke did not arise out of the employment and the appeal is dismissed.
