The court granted leave to amend because the conversion cause of action arose before the counterclaim was filed and amendment was therefore permissible; the court found a serious issue to be tried on conversion, that damages would be inadequate and that the balance of convenience favoured the defendant, and accordingly granted a mandatory injunction ordering delivery of the chop and granted leave to amend the pleadings.
