Application for a pre-emptive costs order was refused because the plaintiff failed to show sufficient strength of case or that it was inevitable a trial judge would order her costs out of the estate, there were no special circumstances warranting departure from the ordinary rule that costs follow the event, and the plaintiff had been hostile to the executors; accordingly costs were ordered against the plaintiff.
