Leave to appeal out of time was refused because the applicant failed to provide a satisfactory explanation for the inordinate delay and there were no substantial and plainly arguable grounds of appeal (conviction based on an unequivocal plea and sentence properly discounted for plea).

The abandonment was a conscious, informed act by the applicant whose mind went with the abandonment; accordingly the abandonment is not a nullity and the application to treat it as such is dismissed, following HKSAR v Lai Siu Cheung.

The facts admitted on the guilty plea and the victim's statement did not establish use of force or overcoming of resistance required by s10(1) Theft Ordinance; therefore the conviction for robbery was unlawful and had to be quashed and the sentence set aside; retrial or substitution was inappropriate given the conviction on plea and time already served.
