On the evidence the 2nd Defendant removed or copied and kept the Plaintiff's confidential customer list, documents and photographs and used them for the 1st Defendant's business; the 2nd Defendant breached express and implied terms of employment and acted as agent for the 1st Defendant; the assignment to the Plaintiff vested past and future copyright in the photographs such that the 1st and 2nd Defendants infringed copyright; the acts also constituted conversion; accordingly judgment on liability entered for the Plaintiff against the 1st and 2nd Defendants with equitable relief ordered.
