Majority held that the father had acquired an accrued right under earlier law (not to be deported) which survived repeal and that the imposition of limitations of stay in his circumstances was invalid or ineffective so that he was "settled" within s.50(2) of the British Nationality Act 1981 at the time of the applicants' births; accordingly the applicants were British Dependent Territories citizens at birth and Hong Kong belongers and the Registrar's refusal to amend the births register was erroneous.
