Judge found the will was executed on 26 May 1979 but, because the instrument was not found in the deceased's custody at death and no adequate evidence rebutted the presumption of revocation, and because the plaintiff's testimony was unreliable and the deceased had possible motives to revoke or misrepresent, the plaintiff failed to prove the contents of the will on the required cautious balance of probabilities and the claim was dismissed.
