The court has jurisdiction under s 52A to order costs against the defendant directors as parties of record and as the real parties who controlled and benefited from the litigation; in the exercise of its discretion the court ordered costs personally against Messrs Hu, Yip and Chung because a costs order against the corporate defendants would be ineffective (PEWC would be compelled to pay its own costs), the directors controlled the defence, knew or must have known of PEWC's beneficial ownership, and the defences were without factual foundation.
