The appeal was dismissed because the Bank, as a prior mortgagee, lawfully exercised its proprietary rights of possession and sale following the defendant's default and therefore did not breach the Mareva injunction which operates in personam; further, the ex parte application for leave to commence committal proceedings was misconceived and procedurally defective for failing to identify the individuals sought to be committed, rendering the proceedings a nullity.
