The Court held it had jurisdiction to determine costs below and, because the judge's basis for awarding indemnity costs in the Order 15 rule 14 application was tied to the striking out orders which this Court overturned, the indemnity costs order could not stand; accordingly the Court varied paragraph 145 to make no order as to costs of CACV 181/2023 both on appeal and below and set aside the costs order in the Order 15 rule 14 application; costs of the variation application were awarded to Lu against the Trustee only and quantified at HKD200,000.
