The court held the arbitration between Linfield and PCL was validly commenced by clear notice dated 28 December 2001; the requirements of s6B(1) were satisfied because common questions of law and fact and overlapping relief arose across the arbitrations; on balance the court should exercise its discretion to consolidate as consolidation would save time and costs and avoid inconsistent findings; where parties cannot agree the court may appoint an arbitrator under s6B(2); accordingly consolidation was ordered and the court appointed Mr John Scott SC; costs were ordered against PCL as specified.
