The solicitors were not ordered to pay the Defendant's costs because the court found Mr Tang (and later Mr Foo) existed and had authorised the proceedings, the amendment operated from the commencement so the action was effectively that of named individuals, and therefore the solicitors had a valid retainer; consequently the court dismissed the Defendant's summons seeking orders against the firms and ordered that the costs of the summons follow the event and be paid by the Defendant.
