The court allowed the withdrawal of the leave application but found no special reason to depart from the normal costs rule; it ordered the applicant to pay the respondent's costs of the leave application and of the withdrawal applications and directed a summary assessment procedure with specified timelines for submission and response of costs statements.

The court exercised its discretion to award costs to the petitioner because the petitioner was a genuine creditor by subrogation and entitled to seek winding up, the strike-out summons lacked sufficient merit on the affidavit evidence, subsequent events did not render the summons academic, and the withdrawal appeared strategic; accordingly Yuen must pay the petitioner's costs including the costs of the argument on costs.

The summons was untenable because the applicant failed to establish prima facie that Pol.42 existed, failed to show the respondent or its predecessor had possession, control or power of it, and failed to demonstrate relevance; accordingly the application could not succeed and, although withdrawn, the applicant must pay the respondent's costs of the application (HK$35,000).
