The Master exercised his discretion to maintain a 40% deduction of the defendants' recoverable costs because despite the defendants' late disclosure of surveillance tapes, the plaintiff had medical reports indicating exaggeration and the late disclosure caused extra expense (an additional witness); accordingly the costs order is amended so that costs from 19 November 1999 are payable to the defendants but subject to a 40% deduction; the plaintiff is awarded costs for the costs application hearing.
