Because the Plaintiffs materially adjusted their case by written opening three days before trial, abandoning certain claims and causing the Defendants to spend additional time and costs on evidence no longer required, the court applied a 35% reduction to the Plaintiffs' recoverable costs and awarded 65% of the costs to the Plaintiffs, to be taxed on the District Court scale if not agreed, with certificate for counsel.
