The Court of Appeal held it had jurisdiction to determine the costs below as part of the appeal, concluded the costs order nisi in §145 had not dealt with costs below, and that because the judge's reasons for awarding indemnity costs were undermined by the Court's allowing the striking out appeals, the indemnity costs order in respect of the Order 15 rule 14 application must be set aside and varied to 'no order as to costs' for both appeal and below; the Court awarded costs of the variation application against the Trustee only and assessed those costs at HK$200,000.
