The plaintiff established its claim by witness evidence and supporting documents; the defendant failed to substantiate its pleaded defence and was debarred from adducing factual witness evidence and did not appear; accordingly the court proceeded in the defendant's absence, allowed the plaintiff's claim for HK$5,322,020, dismissed the counterclaim (provisionally struck out and not restored), ordered costs to the plaintiff and awarded pre-judgment interest from 19 August 2013 at prime plus 1% until judgment and thereafter at the judgment rate.
